Lawsuit by 17 States Challenges Disability Protections

A lawsuit filed by attorneys general from 17 states challenges a 1973 federal law that protects disabled people from discrimination, specifically targeting protections for transgender individuals. The suit aims to remove “gender dysphoria” from the list of protected disabilities under the Rehabilitation Act, but experts warn it could weaken broader disability protections for conditions like ADHD, diabetes, and Down syndrome.

The lawsuit has sparked backlash from advocates and parents, who fear it could lead to the loss of important accommodations, such as extra test time or access to classroom aides, for students with disabilities. Although some attorneys general argue the lawsuit only seeks to reverse the Biden administration’s rule on gender dysphoria, critics say it could have far-reaching consequences.

The lawsuit is currently paused as the new administration reevaluates its position, and some AGs are hopeful that the Trump administration will reverse the Biden rule, potentially dropping the case.
